Built Kindly, LLC, a Delaware limited liability company with its principal place of business at 411 S. State Street, Suite N100, Newtown, PA 18940 (“Built Kindly,” “we,” “our,” or “us”), respects your privacy and is committed to protecting it through our compliance with this Privacy Policy (“Policy”). This Policy describes (i) how we collect, process, retain, use, and disclose your Personal Data (defined below) when you use our website, www.timebeing.app, website application, my.timebeing.app, and any other websites and social media accounts operated, owned, and/or provided by or on behalf of Built Kindly, and any services, features, or content provided through any of the foregoing (collectively, the “Site”); and (ii) our practices for using, maintaining, protecting, and disclosing that information.

This Policy applies only to information we collect:

  • Through the Site.
  • From communications with us, including email, chat, and other electronic messages via the Site.
  • When you interact with our advertising and applications (including mobile apps) on third-party websites, mobile applications, and/or services.

This Policy does not apply to information collected by:

  • Built Kindly through any other means, including on any other website operated by Built Kindly or any third party that does not link to this Policy or our website; or
  • Any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Site.

We may provide additional or different privacy policies that also apply specifically to certain features, services, or activities we offer.

PLEASE READ THIS POLICY CAREFULLY TO UNDERSTAND OUR POLICIES AND PRACTICES REGARDING YOUR INFORMATION AND HOW WE TREAT IT. BY INTERACTING WITH OUR SITE OR PROVIDING US WITH YOUR INFORMATION, YOU AGREE TO THE COLLECTION, PROCESSING, RETENTION, USE, AND DISCLOSURE OF YOUR INFORMATION AS DESCRIBED IN THIS POLICY. THIS POLICY MAY CHANGE FROM TIME TO TIME. YOUR CONTINUED USE OF THE SITE IS DEEMED TO BE ACCEPTANCE OF THOSE CHANGES, SO PLEASE CHECK THE POLICY PERIODICALLY FOR UPDATES.

Children's and Minors' Data

Our Site is not intended for, and we do not knowingly collect any Personal Data from, children under the age of 18. If we learn we have collected or received Personal Data from a child under 18 years old without verification of parental consent, we will delete that information.

Personal Data That We Collect or Process

“Personal Data” is information that identifies, relates to, or describes, directly or indirectly, an individual, such as names, email addresses, telephone numbers, home addresses, or payment information (for example, account information such as name, postal address, and email address, credit card number, or social security number, or any other identifier we may use to contact you online or offline).

“Process” or “Processing” means any operation or set of operations performed on Personal Data or other data or information you provide or make available through your use of the Site, whether or not by automatic means, including, without limitation, collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction, or as otherwise set forth in this Policy.

The types and categories of Personal Data we Process include:

  • Device information, including your IP address, device identifiers, operating system and version, preferred language, hardware identifiers, browser type and settings, and other device information.
  • Content and information you elect to provide as part of your profile or in any reviews you make through the Site or emails, chats, or other communications sent to us or posted on the Site.

Some of the information identified above, including Personal Data, may be considered sensitive data under certain laws. If required under applicable law, we will collect and process sensitive Personal Data only with your consent. If you choose not to provide or allow us to collect some information, we may not be able to provide you with requested features, services, or information.

We also collect:

  • Statistics or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from Personal Data. For example, we may aggregate de-identified Personal Data to calculate the percentage of users accessing a specific Site feature.
  • Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Site, such as clickstream information to, through, and from our Site (including date and time), session tokens, security logs, hashed passwords, page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.

If we combine or connect non-personal statistical or technical data with Personal Data so that it directly or indirectly identifies an individual, we treat the combined information as Personal Data. Built Kindly may use de-identified and aggregated data derived from Customer Data solely for analytics and to improve the Platform, provided that such data: (a) does not identify Customer or any individuals; (b) cannot reasonably be used to reverse-engineer Customer's confidential information; and (c) is not shared with third parties for benchmarking or competitive purposes without Customer's prior written consent.

How We Collect Your Personal Data and Other Data

You Provide Information to Us

We collect information about you when you visit or interact with our Site, such as when you create or update an account or provide feedback or reviews.

Automatically Through Our Site

As you navigate through and interact with our Site, we may use automatic data collection technologies to collect information that may include Personal Data. Information collected automatically may include usage details, IP addresses, operating system, and browser type, and information collected through cookies and other tracking technologies, including details of your interactions with our Site, such as traffic data, location data, logs, and other communication data, and which resources and Site features that you access and use.

Using automatic collection technologies helps us to improve our Site and to deliver a better and more personalized experience.

The technologies we use for this automatic data collection may include:

  • Authentication (Essential) Cookies. A cookie is a small file placed on your device when you interact with the Site. The Site uses authentication cookies solely for authentication purposes (e.g., to maintain your login session if you select “Remember Me”). Built Kindly is not bound by the terms of any third parties' policies and shall not be responsible or liable for any disputes or discrepancies related to any third-party service providers or their respective policies, including any responsibility or liability for third-party treatment of Personal Data. Users of the Site are encouraged to review the privacy policies of any third-party service providers that interact with the Site, including, but not limited to, third-party service providers providing payment and billing services.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any Personal Data, to:

  • Provide you with access to the Site and any contents, features, information, products, or services that we make available through the Site.
  • Track payments using our third-party payment processing providers (e.g., Stripe Connect).
  • Fulfill any other purpose for which you provide it.
  • Provide you with notices about your account.
  • Improve our Site, including by analyzing your information and creating aggregated data derived from your information to develop, maintain, analyze, improve, optimize, measure, and report on our Site and its features and how users interact with them.
  • Carry out our obligations and enforce our rights arising from any agreements entered into between you and us.

  • For any other purpose with your prior consent.

BUILT KINDLY DOES NOT SELL YOUR PERSONAL DATA TO ANY THIRD PARTY OR OTHERWISE SHARE YOUR PERSONAL DATA FOR ANY PURPOSE OTHER THAN AS DESCRIBED IN THIS POLICY.

Who We Disclose Your Information To

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may also disclose Personal Data that we collect or that you provide to us as described in this Policy:

  • To a buyer of Built Kindly or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Built Kindly's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Built Kindly is among the assets transferred.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • Any other purpose with your consent.

We may also disclose your Personal Data:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply this Policy.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our organization, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Your Rights and Choices About Your Information

Promotions by Built Kindly. Built Kindly does not share your information with third-party advertisers, but we may notify you about new Built Kindly products or services if you provide your email address. If you do not wish us to use your information to promote our own products or services, you can opt out by emailing Built Kindly at [email protected].

Your State Privacy Rights

Depending on your state of residency, you may have certain rights related to your Personal Data, including:

  • Access and Data Portability. You may confirm whether we process your Personal Data and access a copy of the Personal Data we process. To the extent feasible, data will be provided in a portable format. Depending on your state, you may have the right to receive additional information and it will be included in the response to your access request.
  • Correction. You may request that we correct inaccuracies in your Personal Data that we maintain, taking into account the information's nature and processing purpose.
  • Deletion. You may request that we delete your Personal Data that we maintain, subject to certain exception under applicable law.
  • Opt-Out of Using Personal Data for Targeted Advertising, Profiling, and Sales. You may request that we do not use your Personal Data for these purposes.

Important: The exact scope of these rights vary by state. There are also several exceptions where we may not have an obligation to fulfill your request.

California Residents

California residents may have additional rights under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (Cal. Civ. Code § 1798.100 et seq. and collectively referred to as the “CCPA”), subject to certain limitations. The obligations and rights in this section do not apply to Personal Data we collect from or about job applicants, vendors, suppliers, independent contractors, current or former full-time, part-time, and temporary employees and staff, officers, directors, or owners of Built Kindly or residents of any state other than California. No user of the Site will be discriminated against for exercising their rights under the CCPA.

As described in this Policy, we may collect various categories of personal information, including without limitation, Personal Data, from visitors of our Site to support, analyze, personalize, and improve our Site, engage in advertising, marketing, and promotional activities, process sales, execute our internal operations, secure and protect our business, and comply with legal obligations.

Subject to certain exemptions, if you are a California resident, the CCPA grants you the following rights:

Request to Know. California residents have a right to request a copy of particular information we have collected about you, up to two (2) times in a 12-month period, subject to certain exemptions. We will deliver this information, free of charge, by mail or electronically in a portable and, to the extent technically feasible, readily usable format that allows the requester to transmit this information to another entity without hindrance, which may include:

  • categories of Personal Data collected;
  • types of sources from which the Personal Data is collected;
  • business and/or commercial purposes for collecting and selling a user's Personal Data; and
  • the categories of third parties with whom we have shared Personal Data.

Request to Delete. California residents have a right to request that we delete any Personal Data about them that we have collected through our Site, subject to certain exceptions. If you are a California resident who makes such a request, once we receive and confirm your verifiable request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our third-party service providers to do any of the following:

  • Complete the transaction for which we collected the Personal Data, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  • Detect, prevent, or mitigate security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Use the information as necessary to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Enable solely internal uses that are reasonably aligned with our normal operations and consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Request to Correct. California residents have a right to request that we use commercially reasonable efforts to correct any personal information about them that we have collected which is inaccurate.

Only you, or someone legally authorized to act on your behalf, may make any of the above requests related to your Personal Data. You may also make a verifiable consumer request on behalf of your minor child. In order for us to act on one of these requests, we must be able to verify your identity or authority to make the request and confirm the Personal Data relates to you, and your request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Data or an authorized representative; and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request and will not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Right to Opt-out of Sale of Personal Information. The CCPA gives California residents 16 years of age or older the right to opt-out of the sale of their personal information at any time. Our Site is not intended for use by children, so we do not sell the personal information of consumers we know are less than 16 years of age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is at least 13 but not yet 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt-in to personal information sales may opt-out of future sales at any time.

Residents of Other States

Certain additional states, including, without limitation, Colorado, Delaware, Indiana, Iowa, Kentucky, Minnesota, Montana, Nebraska, Oregon, Rhode Island, Tennessee, Utah, Texas, New Jersey, Connecticut, Virginia, Maryland, and New Hampshire provide their state residents with certain rights, including the right to:

  • Confirm whether we process their Personal Data;
  • Access and delete certain Personal Data;
  • Correct inaccuracies in their Personal Data, taking into account the nature and processing purpose of the Personal Data;
  • Data portability;
  • Opt-out of personal information processing for: targeted advertising, sales, or profiling in furtherance of decisions that produce legal or similarly significant effects; and/or
  • Limit our ability or require your consent to process Personal Data.

The exact scope of these rights varies by state. How We Protect Your Personal Data

We use commercially reasonable administrative, physical, and technical measures designed to protect your Personal Data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your Personal Data transmitted to, through, using, or in connection with the Site. In particular, email communications sent to or from the Site may not be secure, and you should carefully decide what information you send to us via such communications channels. Any transmission of Personal Data is at your own risk.

The safety and security of your information also depends on you. You are responsible for taking steps to protect your Personal Data against unauthorized use, disclosure, and access.

How We Retain Your Personal Data

We keep the categories of Personal Data described in this Policy for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining the Site, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain Personal Data. At the end of the retention period, Personal Data will be deleted, destroyed, or deidentified.

Changes to Our Privacy Policy

We may update this Policy from time to time, and we will provide notice of any such changes to the Policy as required by law. The date the Policy was last updated is identified on the first page. We will notify you of changes to this Policy by updating the “last updated” date and posting the updated Policy on our website. We may email or otherwise communicate reminders about this Policy, but you should check our Site periodically to see the current Policy and any changes we have made to it.
